What a wage differential is
A wage differential, also called a pay differential (فروق الأجور), is an amount added to an employee’s wage because a condition of their work differs, not because their performance differs and not because their grade differs. What it pays for is the condition: a night shift, a remote site, a hazard in the working environment, or a skill in short supply in the market.
The definition carries a test that holds the whole concept together: a wage differential follows its condition, and ends when the condition ends. An employee moved from a remote site to head office no longer receives the site differential, and one who leaves the night shift no longer receives the night differential. An amount that continues after its cause has gone is no longer a differential in this sense. It has left this category for another, with different rules.
Where Article 2 of the Labor Law places a wage differential
Where a differential sits decides two questions: whether it enters the base of the end of service award, set out under end of service calculation, and whether the organisation can remove it. Article 2 of the Saudi Labor Law (نظام العمل), in defining the actual wage (الأجر الفعلي), lists five items, and two of them are where wage differentials fall. The exact wording carries the point, so those two items of Article 2 of the Labor Law, the second and the third, are given in Arabic:
«البدلات التي يستحقها العامل لقاء طاقة يبذلها، أو مخاطر يتعرض لها في أداء عمله.»
«الزيادات التي قد تمنح وفقاً لمستوى المعيشة، أو لمواجهة أعباء العائلة.»
In our own rendering, which is not an official translation, the first of these covers allowances due to the worker in return for energy they expend, or for risks they are exposed to in performing their work. The second covers increases that may be granted according to the standard of living, or to meet the burdens of a family.
The allowances item is narrower than it can be taken to be. It does not speak of allowances without qualification; it describes the allowance by its cause: energy the worker expends, or a risk they are exposed to. An allowance paid for a risk falls within its wording, and so does an allowance paid for exceptional effort. An allowance that carries the name but answers to neither cause is not described by that wording.
The position of the standard of living item deserves attention. A standard of living increase is written into the list of items in the actual wage, whereas periodic increments (العلاوات الدورية) are written into the definition of the basic wage (الأجر الأساسي) itself. These are two positions in one Article, and they do not merge. Treating a cost of living differential as a periodic increment moves an item from one list to the other, and the effect shows at the first entitlement calculated on the basic wage alone.
The social insurance contribution base is a separate matter, and we take no position on how wage differentials are treated in it, because that base is defined by the Social Insurance Law, not by Article 2 of the Labor Law. It has its own sources, covered in our guide to the GOSI contribution wage.
A worked example of why a wage differential is not a percentage
Two employees are in the same grade, each with a basic wage of SAR 9,000. The first works at head office. The second works at a remote site, with a site differential of SAR 1,200, and is exposed to a described hazard, with a hazard differential of SAR 600.

The visible gap between the two is 20%, and in the pricing of the grade it is zero. If the second employee moved to head office and both differentials ended, their pay would return to SAR 9,000. That would not be a cut in their wage, because what ended was payment for a condition that had ended.
This is why an employee’s position within the range for their grade is not measured on the actual wage. Assume the midpoint of the grade’s range is SAR 9,000. A compa ratio computed on 10,800 gives 1.20 and can make the second employee appear to sit 20% above the midpoint, when, measured on the base on which the range was built, the ratio is 1.00 and they sit exactly at the midpoint. The rule is to measure position on the base on which the range was built, and to place wage differentials on top of that base, not inside it.
The figures in the example are illustrative. We set no percentage or amount for any wage differential, and in the sources we reviewed we found no provision setting a percentage for a site differential, a hazard differential or a scarcity differential. A figure seen in practice should not be carried over into a statement of what the text requires.
How a wage differential can become part of the wage
Among the items of the actual wage, Article 2 of the Labor Law also lists a grant or bonus, and counts it only where one of three alternative conditions is met. It must be provided for in the employment contract or in the establishment’s work regulation (لائحة تنظيم العمل), or it must have been granted by custom until workers came to regard it as part of the wage and not as a gratuity.
That last limb is what can turn a temporary differential into a fixed element of the wage. Suppose an organisation paid a differential for a passing condition, then kept paying it after the condition ended, year after year, with no decision renewing it and no document limiting it. It may then have built a custom. The risk is not in the amount. It is that the organisation believes it is paying a differential that can be stopped, when a different description has come to fit.
Article 2 of the Labor Law describes the custom limb by its character and gives it no duration. In the sources we reviewed, we found nothing that fixes, by a number of months or of payments, the point at which a customary payment becomes an entitlement under that limb.
Three things, written before the first payment rather than after the first dispute, guard against this: the triggering condition, described so that its presence and its absence can be recognised; the review period; and the effect of the condition ending, stated in the same document that sets the amount.
The night shift differential: an obligation without a rate
The night shift differential, one form of shift differential, has a particular position in the Saudi market. Compensation for night work is an obligation under Ministerial Decision No. 18632 dated 30/01/1441H on night working hours, but that decision sets no percentage, no multiplier and no minimum amount. Its compensation clause reaches night work that meets thresholds set in the decision itself. The duty is fixed, but its form is left to the employer. Ministerial Decision No. 18632 names instances by way of illustration only, and one of them is a reduction in actual working hours in place of an increase in pay.
A night differential may therefore not be an amount at all. The detail of the decision, including the workers it covers and its thresholds, is a subject in itself. For the definition of a wage differential one rule follows: a differential that answers a regulatory obligation is not a recruitment tool the organisation chooses, and it is not presented in the organisation’s documents as a competitive benefit, because paying it performs a duty and confers no favour.
Kinds of wage differential, and what ends each one
What appears in one table under the heading of differentials can be three kinds of wage differential, alike in form and different in duration and in what ends them:

Confusing them produces a specific error in each direction. A scarcity differential managed as a condition differential stays with the holder after the market has filled with the skill, because the person has not moved and their role has not changed, so nothing sets off its ending. Managed as a scarcity differential, a location differential gets tied to market data that does not describe it, since the question is the cost of the place, not the supply of the skill. A condition differential managed as a location differential is reviewed once a year with the locations, while its cause may have ended three months earlier when the employee moved between teams.
A location differential paid as a separate amount is also a different design from geographic pay differentials, under which the pay range for a job itself changes from one location to another under a published rule.
The practical rule is to write the ending mechanism beside each kind, not the review cycle alone. The review cycle asks whether the amount is right. The ending mechanism asks whether the cause still exists, and that is the question that decides whether the line stays at all.
How a wage differential differs from pay equity, variable pay and overtime pay
Each of these neighbours sits on a different axis from a wage differential.
- Pay equity. Its question is whether every gap in pay has a cause connected with the work that can be stated and examined. A wage differential is one of those causes, written in advance and announced. A designed differential does not replace the examination, because the examination asks about the gaps that have no explanation.
- Variable pay. It moves with a result achieved by the individual, the team or the organisation, as commission pay does. A wage differential does not move with a result; it moves with the presence or absence of a condition. Linking a site differential to performance creates a hybrid arrangement that cannot be placed under either heading.
- Overtime pay. It pays for hours worked above the statutory ceiling, and Article 107 of the Labor Law sets how it is calculated, as explained in our guide to compensatory rest and overtime. A shift differential pays for when the hours fall, not how many there are. A night hour within the ceiling does not generate overtime pay merely because it falls at night.
What makes a table of wage differentials defensible
- A closed list of approved differentials, each with a name, a triggering condition, and an amount or a rule of calculation. Any differential outside the list is an exception that needs a decision naming the person it covers and its duration.
- A stated base for each differential: whether or not it enters the calculation of entitlements. The label alone is not enough, because Article 2 of the Labor Law places an arrangement by its cause, not by its name.
- Periodic review of the condition itself, not only of the amount. A scarcity differential for a skill that is no longer scarce has its cause reviewed before its value.
- The differential shown as a separate line on the payroll statement, not merged into the wage line. Merging it makes stopping the differential look like a pay cut to anyone reading the statement.
A wage differential paid to one person
A table of differentials can be undermined less by a line written in it than by an amount paid outside it for a single case. One form this takes: an employee receives an outside offer and is then paid a differential in the name of location, hazard or scarcity, whose real cause is to keep that one person.
The harm is twofold. First, the table now holds a line whose name does not describe its cause, and whoever next examines the differentials finds a case that does not meet the condition of its line. Second, the organisation has set a precedent it cannot contain, because others in the same condition will ask for the same amount, and the only answer available is that the differential was never for the condition.
The remedy is not prohibition, since retention is a real need. It is to pay the amount for its purpose and under its name: a retention payment such as a retention bonus, described by its duration and its condition, kept outside the table of differentials, and recorded in a decision naming the person. An amount named for what it is gets examined on its terms, and anyone in the same position is measured against it. An amount that borrows another name gets examined on that other name’s terms, and fails them.
The statutory provisions behind a wage differential
The provisions relied on are those of the Saudi Labor Law as published by the Ministry of Human Resources and Social Development: Article 2 of the Labor Law (the definitions of the basic wage and the actual wage, the allowances item, the standard of living item, and the grant or bonus item with its custom limb) and Article 107 of the Labor Law (overtime). Ministerial Decision No. 18632 dated 30/01/1441H, in force since 1 January 2020, is relied on for the obligation to compensate night work without a set rate. Royal Decree M/44 of 1446H, in force since 19 February 2025, amended Article 2 of the Labor Law by adding definitions, and amended Article 107 of the Labor Law. That decree did not change the definitions of the basic wage and the actual wage in Article 2 of the Labor Law.
Checking each wage differential line by line
An organisation reviewing its table of wage differentials can begin with one question for every line in it: if the condition ended tomorrow, which document would stop the amount? Where no document answers, the ending of that line has not yet been written down.
